WHO ARE WE?

Digital Coalition is an interest association of legal entities, with its registered office at Pribinova 17954/10, 811 09, Bratislava, Slovak Republic, Company ID: 52 828 123, registered in the Register of Interest Associations of Legal Entities maintained by the Bratislava District Office under registration number OUBAOVVS12019/140232 (Digital Coalition).

Pursuant to Article 13 and Article 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR), the Digital Coalition, as the controller, hereby provides you as the data subject with information on the purposes of personal data processing, including cases where personal data are not obtained directly from the data subject.

It is necessary that you familiarise yourself with and understand this information no later than at the time your personal data are collected.

ONGOING COMMITMENT TO PRIVACY

We respect the privacy of all natural persons whose personal data we process in the course of our activities and therefore commit to protecting your privacy and handling all information we collect and retain about you in a responsible manner.

By familiarising yourself with this information, you acknowledge that we may collect, use, and where necessary disclose your personal data to public authorities or third parties to the extent and in the manner described below.

It is important to us that you understand why and how we handle your personal data. Please read the information below on how we obtain your personal data, how we handle it, and what rights you have in connection with the processing of personal data by the Digital Coalition.

WHAT IS PERSONAL DATA

We consider personal data to be any information about an identified or identifiable natural person, such as first name, surname, email address, telephone number, IP address, national identification number, date of birth, income information, and similar.

As the controller, we may process your data for various purposes, whereby the legal basis for processing, the duration of processing, and the retention period may differ depending on the purpose of the processing operations.

HOW WE PROCESS YOUR PERSONAL DATA

We may process your personal data in various ways and for various purposes depending on whether you are merely a visitor to our website, a person interested in education within the Digital Coalition’s projects, an employee, a volunteer, or a job applicant. However, we always handle your data in accordance with applicable personal data protection regulations.

In the interest of strengthening the guarantee and legal protection of your rights and freedoms in the processing of your personal data, we have appointed a responsible person to oversee the lawfulness of the processing of your personal data.

The responsible person is your point of contact for any questions or requests relating to personal data protection and the exercise of your rights. You may contact them using the contact details provided above. If your message is in writing, always mark it “for the attention of the responsible person“.

PROTECTION OF PERSONS UNDER THE AGE OF 16

If you are under 16 years of age, please ask your legal representatives for consent before providing us with any personal data about yourself or your legal representatives. Without such consent, you are not authorised to provide us with your personal data.

WHAT ARE YOUR RIGHTS AS A DATA SUBJECT

Under applicable personal data protection legislation, you as a data subject have the following rights.

[Right of access] You have the right to receive a copy of the personal data we hold about you, as well as information on how we use your personal data. In most cases, your personal data will be provided to you in written paper form, unless you request otherwise. If you have requested this information by electronic means, it will be provided to you electronically where technically possible.

[Right to rectification] We take reasonable steps to ensure the accuracy, completeness, and currency of the information we hold about you. If you believe that the data we hold is inaccurate, incomplete, or out of date, please do not hesitate to ask us to correct, update, or supplement this information. As a data subject, you have the right to rectification of personal data concerning you if it is incorrect, or to have it completed if it is incomplete. We are obliged to comply with your request for rectification or completion of personal data without undue delay.

[Right to erasure] In certain circumstances, you have the right to request that we erase your personal data, for example where the personal data we have obtained about you is no longer necessary for the purpose for which it was originally processed, or where you withdraw your consent to processing. However, your right must be assessed in light of all relevant circumstances. For example, if processing of your data is necessary for compliance with a legal obligation or for the establishment, exercise, or defence of legal claims, we may not be required to comply with your request.

[Right to restriction of processing] In certain circumstances, you are entitled to request that we cease using your personal data. This may apply, for example, where you believe that the personal data we hold about you is inaccurate, or that we no longer need to use your personal data. Where processing has been restricted in accordance with Article 18(1) of the GDPR, such personal data shall, with the exception of storage, only be processed: (a) with the consent of the data subject, or (b) for the establishment, exercise, or defence of legal claims, or (c) for the protection of the rights of another natural or legal person, or (d) for reasons of important public interest of the Union or of a Member State.

[Right to data portability] In certain circumstances, you have the right to request that we transfer the personal data you have provided to us to another third party of your choice. Where processing is based on consent or on a contract and is carried out by automated means, you have the right to receive your personal data that you have provided to us in a structured, commonly used, and machine-readable format, and have the right to transmit those data to another controller. Where technically feasible, you have the right to have the data transferred directly from one controller to another.

[Right to object] Where processing is based on our legitimate interests (Article 6(1)(f) of the GDPR), you have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you, including objecting to profiling based on those interests. In such a case, we may no longer process your personal data unless we demonstrate (i) compelling legitimate grounds for processing which override your interests, rights, and freedoms as a data subject, or (ii) grounds for the establishment, exercise, or defence of legal claims. Where you object to the processing of personal data for direct marketing purposes, including profiling to the extent that it relates to such direct marketing, the personal data shall no longer be processed for such purposes.

[Rights related to automated decision-making] You have the right to refuse automated decision-making, including profiling, which produces legal or similarly significant effects concerning you.

[Right to withdraw consent] In most cases, we do not process your personal data on the basis of your consent. Where in specific cases we process your data on the basis of your consent, you have the right to withdraw your consent to the further use of your personal data.

[Right to lodge a complaint or seek judicial remedy] As a data subject, you also have the right to lodge a complaint at any time with the supervisory authority, which is the Office for Personal Data Protection of the Slovak Republic (further information can be found on the website www.dataprotection.gov.sk), or to bring proceedings before the competent court.

FEEDBACK REGARDING THE USE OF YOUR PERSONAL DATA

The protection of your personal data matters to us, and we therefore strive to secure it through individual, modern technical and organisational measures, as well as through the ability to exercise your rights as a data subject under the GDPR at any time by submitting a request.

Requests to exercise your rights as a data subject may be sent to us electronically or in writing to the contact details of the responsible person provided above. This procedure does not affect your right to withdraw consent to the processing of personal data, which you may withdraw at any time as easily as you granted it (e.g. if you granted consent electronically, you may always withdraw it by email or through the contact interface on the Project website without the need to send a written request to our address), or your right to object by automated means using technical specifications, where available.

We recommend that with each request you explain as clearly as possible which right under the GDPR you are exercising, your identification details (for identity verification), and, where applicable, the purposes and data to which the request relates. In the case of overly general requests, we may need to ask for clarification.

The GDPR sets out the general conditions for the exercise of your individual rights. However, their existence does not automatically mean that individual requests will be granted, as exceptions may apply in specific cases, or certain rights are subject to specific conditions that may not be met in every instance. Any request concerning a specific right will always be examined by us in light of the applicable legislation and our internal policy for handling data subject requests.

If the Digital Coalition is not competent to assess your request to exercise a data subject right, your request will be forwarded without delay to the competent controller.

Every request to exercise a data subject right received by us will be assessed individually and competently, and we will inform you of the outcome no later than one month from the receipt of your request.

Please note that when processing your request to exercise a data subject right under the GDPR, we may ask you to reliably verify your identity, particularly in cases where there are doubts as to your identity. It is our obligation to prevent the disclosure of personal data about you to an unauthorised person. The process of handling your request in connection with the exercise of your data subject rights under the GDPR is free of charge. If your request is manifestly unfounded or excessive, in particular because of its repetitive nature, we are entitled to charge a reasonable fee that takes into account administrative costs.

CHANGES TO THESE TERMS

Personal data protection is not a one-off matter for us. The information we are obliged to provide to you in relation to the processing of your personal data may change or may cease to be current.

We therefore reserve the right to amend and change these terms at any time and to any extent. If we change this information in a material way, we will bring this change to your attention, for example by means of a general notice on this website or a specific notification by email.
